REGULATIONS CONCERNING THE RULES FOR RETURNING GOODS

VALID AT THE ASTRJA STAND FROM JUNE 1, 2019

§ 1

 

1. These regulations (hereinafter referred to as the "Regulations") define the rules for the sale and return of Goods at the Astraja stationary stand, which are binding on each Consumer.

2. Sales covered by these Regulations will be carried out from June 1, 2019 until the date of public announcement (in accordance with §11) of the cancellation of the following sales and return rules.

 

§ 2

 

The phrases used in these Regulations mean:

Organizer - Astraja Agnieszka Madej based in Czaniec ul. Beskidzka 40

Sales covered by these Regulations - each sales contract (subject to §5 of the Regulations) concluded with the participation of the consumer, under which the Consumer purchases the Goods at an Astraja stationary stand.

Goods - clothing and other goods creating or complementing the styles and fashion trends of the Astraja brand, which are in the current offer of the Astraja stationary stand, which is subject to sales covered by these Regulations,

Astraja stationary stand - a stand located in Poland where the Goods are sold and which is indicated in §12 of these Regulations.

Consumer - an adult natural person (or a natural person who is over 13 (thirteen) years of age and has the consent of parents or guardians, unless such consent is not necessary in the light of applicable regulations) who accepts these Regulations and the principles of Sales covered by these Regulations specified therein and is also a person purchasing the Goods as a consumer within the meaning of generally applicable law.

 

§ 3

 

Sales covered by these Regulations will take place at Astraja stationary stands located in Poland.

 

§ 4

 

Sales and returns covered by these Regulations are based on the following principles:

1. The consumer has the right, but not the obligation, to use the sales principles covered by these Regulations, as well as all the rights he is entitled to under these Regulations.

2. The refund covered by these Regulations is based on the following principles:

a) The consumer has the right to return Goods purchased at any Astraja stationary stand in Poland within 30 days from the date of purchase. The refund will be settled in the same form as the purchase was made.

b) The consumer has the right to return at any Astraja stationary stand only goods purchased only at the stand. Products purchased through the online store cannot be returned at the stand.

 

Goods that the Consumer intends to return under the terms of these Regulations:

a) it cannot show any signs of use, in particular it cannot be mechanically damaged or have any other, even minor, physical defects,

b) it must have all markings (including tags) permanently attached to it, which the seller provided to the Goods at the time of purchase. Such markings must be original (i.e. come from the seller) and cannot bear traces of having been removed and reattached to the Goods,

c) Goods that were specifically packaged at the time of sale should be in intact original packaging,

d) Goods whose price has been reduced at the time of sale due to physical defects, damage or incomplete value of the Goods cannot be returned.

 

The following Goods offered for sale at Astraja stationary stands are not subject to exchange or return subject to these Regulations:

- underwear

- Goods modified at the consumer's request

- tights, socks, hairbands or other hair accessories, e.g. hair bands

 

a) In order to use the Return Policy covered by these Regulations, the Customer should go in person to any Astraja stationary stand, and present and deliver to the seller the original fiscal receipt that was issued to him at the time of purchase of the returned Goods,
b) If the seller determines that a given situation qualifies for the return of the Goods in accordance with these Regulations, the seller will collect the Goods from the Customer as well as the fiscal receipt issued to the Customer at the time of purchase and then make a refund in the same form as the purchase was made

3. Failure to notify the willingness to use the option of returning the Goods (according to the terms described in these Regulations) within 30 days from the date of purchase means that the Consumer has ceased to exercise his rights under these Regulations. In such a situation, upon the expiry of the deadline referred to in the preceding sentence, he finally loses the opportunity to exercise his rights under these Regulations in relation to the Goods for which the deadline has expired.

 

§ 5

 

The sale covered by these Regulations does not cover Goods whose price, due to physical defects, damage or incomplete value, has already been covered by promotions, discounts, rebates, markdowns or other special price offers. No other return policies indicated in separate promotional campaigns are subject to connection with these Regulations. In case of doubts as to whether a specific Good is covered by promotions, discounts, rebates, markdowns or other special price offers, the information from the manager of the Astraja stationary stand is decisive.

 

§ 6

 

1. Before purchasing the Goods, the Consumer should make sure whether the Goods he intends to purchase are subject to sale covered by these Regulations, i.e. whether if he requests the return of the Goods within 30 days (on the terms described in the Regulations), he will have the opportunity to return them. on the terms described in the Regulations.

2. A consumer who intends to take advantage of the sale and return covered by these Regulations has the right and obligation to read these Regulations, which are available for inspection at the stationary Astraja stand where he or she made the purchase. The sale covered by these Regulations applies.

 

§ 7

 

Information about sales covered by these Regulations does not constitute an offer or public promise. The seller is not responsible for incorrect or incomplete reading of the sales slogan covered by these Regulations.

 

§ 8

 

The Organizer has the right to cancel or shorten the duration of the sales rules covered by these Regulations without giving reasons, by placing written information at the Astraja stationary stand.

 

§ 9

 

The principles described in these Regulations do not prevent the Consumer from pursuing claims under the Act of May 30, 2014. on consumer rights (Journal of Laws of 2014, item 827) . The basis for any complaints about the Goods is the proof of purchase of the Goods.

 

§ 10

 

Any possible complaints related to the manner of sale covered by these Regulations, the Consumer is obliged to submit in writing to Astraja Agnieszka Madej with its registered office in Czaniec ul. within 3 days from the date of attempting to return it. Beskidzka 40 to consider the validity of the complaint or request.

 

§ 11

 

The Organizer may amend these Regulations, in particular in terms of increasing or decreasing the number of stationary Astraja stands covered by this sale, as well as in terms of changing its rules. The change becomes effective from the date of placing appropriate written information at the Astraja stationary stand.

 

§ 12

 

1. The organizer is not responsible for any disputes arising from reasons attributable to third parties.

2. The Organizer will make these Regulations available for viewing at all stationary Astraja stands that are covered by the sales described in these Regulations.

3. All disputes related to sales covered by these Regulations will be resolved by the court having jurisdiction over the seat of the Organizer, unless mandatory legal provisions provide otherwise.
